STANDARD TERMS AND CONDITIONS

STORAGE POLICY

1. Notification of Ready Orders: Once your order is ready to ship, a Brava Shipping Coordinator will contact you.

2. Initial Holding Period: If you are not ready to receive your order, we will hold the material for 30 days without any charges.

3. Cancellation of Orders: If your order remains in storage for longer than the initial 30-day period without communication or action from your side, Brava reserves the right to cancel your order. In such a case, the material will be repurposed for other orders. See cancellation policy below for additional fees.

4. Storage Charges: Should your order need to be stored for longer than 30 days, a storage rate will apply. The storage rate is $50 per pallet per month, which equates to $1.66 per day (prorated). This charge will be incurred for each day beyond the initial 30-day period that your order remains at our facility.

CANCELLATION POLICY

For Order Cancellation prior to production, a 10% cancellation fee will be applied. The customer is responsible for all shipping charges, including cancellations after order shipment. All cancellations will be reviewed by management for extenuating circumstances.

RETURN POLICY

1. All sales are final.

2. Returns require approval.

3. Returns are typically approved for products that are clean, well-packaged, sorted, and in new condition. We reserve the right to refuse a return for any items that do not meet these standards.

4. A restocking fee of 30% plus freight applies to all non-stocking returns.

SHIPPING

Freight quotes subject to change for any undisclosed requirements. Tile and accessories are loaded on pallets.

Full Truckload (FTL) Shipments:

  • The customer is responsible for unloading all FTL shipments upon arrival

Less-Than-Truckload (LTL) Shipments:

  • In the absence of a forklift or loading dock at the delivery location, the carrier will utilize a liftgate to lower pallets to ground level
  • Pallets will be left at the nearest accessible point, typically at the driveway's edge or the closest safe location along the road

ORDER QUANTITIES

Order quantities are the responsibility of the customer. Brava is not responsible for shortages and/or add-on orders that result from incorrect order quantities.

PROPER MATERIALS:

Brava is not responsible for damage or loss due to incorrect material order or supply. It is the responsibility of the customer to ensure proper material has been ordered and received prior to acceptance.

DAMAGES

Delivery damage to product and/or property is subject to 3rd party claim process. We highly recommend inspecting products and property for damages prior to signing for delivery. If damage is found; notify the driver, document, and contact Brava to aid in resolution. Failure to document damages during delivery may complicate resolution.

INSTALLATION

Brava Tile has no liability for issues or damages arising from an incorrect installation by the contractor.

COLOR DISCLAIMER

Customer acknowledges that color is impacted by illumination sources, viewing distances, viewing angles, unique material characteristics, and diversity of recycled raw materials among other factors. Brava encourages a sampling of products for a representative color range prior to purchase. Color variances within normal manufacturing range are not grounds for rejecting product, returns, or failing to pay seller’s invoices. For Class A or custom colors, an approved sample is required prior to order. Special pricing and/or charges may apply.

INSURANCE

Each Party shall maintain adequate insurance coverage (including without limitation workers compensation, employer’s liability, comprehensive general liability, product liability and property damage insurance) at its own expense in accordance with good commercial practice and shall furnish certificates of insurance evidencing such insurance coverage to the other Party upon request. Such insurance may be provided under any insurance program maintained by a Party or its corporate group.
